Pending or Active Criminal Cases

If a criminal case is pending, under active investigation, or has not yet been adjudicated in court, the Rincon Police Department will generally release only the initial incident report.

The following materials are typically not available for release while a case remains active, pursuant to exemptions within the Georgia Open Records Act:

  • Supplemental reports
  • Investigative notes or case files
  • Witness statements
  • Interviews or interrogations
  • Evidence or investigative materials

Additional records may become available after the case has been adjudicated through the court system.

Body-Worn Camera (BWC) Footage

Body-worn camera footage associated with criminal investigations is not available for release through the open records process until the related case has been adjudicated.

When footage becomes eligible for release, requests are subject to the following:

  • Research, review, and redaction fees of $22.00 per hour as permitted by O.C.G.A. § 50-18-71
  • Required redactions to protect information exempt from disclosure under Georgia law

Requestors will be notified of any applicable fees prior to processing when appropriate.

Requests Referencing Media Reports or Third-Party Sources

The Rincon Police Department frequently receives open records requests referencing news articles or third-party websites.

Please note:

  • Referencing a media report does not guarantee that the Rincon Police Department possesses all records referenced in that report.
  • The department will provide only records maintained by this agency that are eligible for release under Georgia law.
  • Requests for records maintained by other agencies must be directed to the appropriate agency.

Fees

Fees for search, retrieval, review, redaction, and reproduction of records may apply as permitted under the Georgia Open Records Act. Requestors will be notified of applicable costs when required prior to processing.
